About Us and Our Role
CABI TAXI APP LIMITED acts solely as a booking and dispatch platform and is not responsible for the provision of transport services.
These terms and conditions govern the use of CABI TAXI APP, which operates as a technology-based dispatch service connecting passengers with independent SPSV licensed taxi drivers.
CABI TAXI APP does not provide transport services. All transport services are provided by independent third-party drivers. Any contract for transportation is formed directly between the passenger and the driver.
User Eligibility
By using the platform, you confirm that:
- You are at least 18 years of age.
- All information provided is accurate and up to date.
Booking and Service Use
The platform enables users to request and arrange transport services with drivers. CABI TAXI APP does not guarantee the availability of drivers or the completion of any booking.
Drivers operate independently and are not employees, agents, or representatives of CABI.
Once a booking is accepted, the passenger is responsible for being available at the agreed pickup location.
When using CABI to request a booking:
- Requests are not guaranteed due to availability.
- Drivers can accept or reject jobs.
- Drivers can cancel bookings where necessary.
- ETA is an estimation only.
- Delays can occur due to traffic and other external factors.
Service Fees and Charges
Fares are determined by the taximeter in accordance with NTA regulations. CABI applies a separate platform service fee of €0.50 per booking, which contributes to payment processing costs, platform operation and administrative services. This fee may be subject to change in the future.
Any additional fees permitted under SPSV regulations, including charges for extra passengers, may be applied.
Any fare displayed prior to booking is an estimate provided for guidance only. The final fare is calculated by the taximeter in accordance with SPSV regulations and may vary due to traffic conditions, route changes, or other factors.
Payments
Payments are processed through the app using a third-party payment provider (currently Stripe). CABI does not store full payment card details.
By using the app, you authorise CABI to:
- Charge your selected payment method for completed journeys.
- Pre-authorise payments when a booking is made.
- Currently, CABI does not accept cash bookings; all payments must be made through the app.
CABI reserves the right to introduce cash payment options or other payment methods in the future, subject to updated terms.
Cancellations and No-Show Policy
Passengers may cancel a booking within a reasonable time of placing it.
A cancellation fee of €5 may apply where a driver has already been dispatched or has arrived at the pickup location. CABI reserves the right to update this amount with notice.
If a passenger fails to attend the pickup location, the driver may mark the trip as a no-show and a fee of €5 will be charged to the passenger's payment method.
Refund Policy
Refunds are not guaranteed and are issued solely at our discretion. Customers may request a refund by contacting support@cabi.ie within 7 days of the journey, including all relevant journey details.
Each case is reviewed on a case-by-case basis. We reserve the right to decline refund requests where no error or service failure has occurred on the part of CABI.
Submitting a chargeback without first contacting us may result in account suspension.
In cases where an overcharge is claimed, we may request supporting evidence such as a taximeter receipt. We may also review trip data, including GPS and fare records, when assessing refund requests.
App Availability and Technical Issues
CABI TAXI APP does not guarantee that the platform will always be available or free from errors. We are not liable for any interruptions, technical issues, or system failures beyond our reasonable control.
Driver Requirements
Drivers using the platform must:
- Hold a valid SPSV licence issued in Ireland.
- Maintain valid SPSV motor insurance
- A valid SPSV vehicle certificate.
- All legally required certifications.
Ensure their vehicle is roadworthy and compliant with all applicable regulations.
Drivers are solely responsible for the provision of transport services, including safety, conduct and compliance with all applicable laws.
Loss, suspension or expiry of any licence or insurance automatically suspends access to the Platform.
Drivers act as Independent Contractors and are not workers or employees of CABI TAXI APP.
Drivers are solely responsible for their own regulatory obligations, taxes and PRSI contributions.
By registering as a driver on the platform, you agree to the CABI Driver Agreement, which sets out onboarding, payment, and offboarding procedures in full.
Feedback, Professionalism and Standards
Passengers can submit feedback and share their experience of trips through the app.
Repeated poor behaviour, safety issues or violations of SPSV regulations could lead to a warning, suspension, or permanent loss of access to the platform.
Operational Standards
The following operational standards apply to all drivers using the platform:
- Treat all passengers with respect and in compliance with equality and non-discrimination laws.
- Any incident or accident must be reported to support@cabi.ie as soon as reasonably practicable.
- In the event of an emergency or serious situation, contact local emergency services without delay.
Account Suspension and Termination
CABI reserves the right to suspend or terminate access to the platform where:
- These terms and conditions are breached.
- Fraudulent or unsafe behaviour is suspected.
- Required documentation is invalid, expired, or not provided.
- Suspension or termination may occur without prior notice where necessary for safety reasons.
Driver Subscription and Fees
Drivers are enrolled in a recurring monthly membership, currently €12.50 per month. The membership fee is automatically deducted from the driver's CABI account balance each month. This membership is required to receive bookings from CABI TAXI APP and is not linked to revenue or trip volume.
For each completed booking, a commission of 10% of the fare is deducted and retained by the platform.
The monthly membership is automatically deducted from the driver's CABI account balance on the applicable monthly billing date.
If there are sufficient funds in the driver's account balance to cover the monthly fee, CABI reserves the right to restrict or suspend access to the platform until the outstanding balance has been resolved.
CABI will provide at least 30 days' written notice of any change to the monthly membership fee.
Drivers are responsible for collecting and remitting any additional charges such as a soiling charge, which must be collected directly from the passenger and is not the responsibility of the platform.
Dispute Resolution
In the event of a dispute between a passenger and a driver, CABI will endeavour to assist in the resolution of the matter where possible, but accepts no liability for the actions or conduct of either party. Passengers and drivers are encouraged to contact support@cabi.ie in the first instance. CABI's decision in relation to platform access (e.g. suspension) is final. Any unresolved legal disputes shall be subject to the jurisdiction of the Irish courts.
Changes to Terms
CABI TAXI APP reserves the right to update or modify these terms at any time. Continued use of the platform following notification of changes constitutes acceptance of the updated terms.
Limitation of Liability
CABI TAXI APP LIMITED acts solely as a technology platform facilitating connections between passengers and independent SPSV licensed drivers. CABI does not provide transport services and has no control over the actions, conduct, or services provided by drivers or passengers.
To the fullest extent permitted by law, CABI shall not be liable for:
- Any injury, loss, damage, delay, or inconvenience arising from any journey or transport service.
- The conduct, actions, or omissions of any driver or passenger.
- Vehicle condition, road conditions, or external factors.
- Delays, cancellations, or failure to complete a booking.
- Any indirect, incidental, special, or consequential losses.
- Loss of profits, revenue, business, or opportunity.
- Loss or damage to personal belongings.
All transport services are provided by independent drivers, who are solely responsible for the provision of transport services, compliance with all legal and regulatory requirements, and passenger safety.
Any claims arising from a journey must be directed to the driver or their insurer, not CABI.
CABI's total liability, if any, shall be limited to the amount of fees paid by the user to CABI in the 3 months preceding the claim.
Nothing in these terms excludes or limits liability where it cannot be excluded under Irish law, including liability for death or personal injury caused by negligence.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
Data Protection
CABI processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and applicable Irish data protection legislation.
